Bob Whitman's practice focuses on patent litigation. Mr. Whitman has more than 30 years' experience litigating patents in district courts throughout the United States and before the International Trade Commission.  

Mr. Whitman has worked on some of the nation's highest-profile patent litigations. He was counsel for Toyota Motor Corp. in a much-publicized litigation initiated by the alleged inventor of the intermittent windshield wiper. Mr. Whitman secured a dismissal of the litigation even though the plaintiff had previously obtained, on the same patents, a multi-million-dollar verdict against Ford (which was made into the movie Flash of Genius). His trial experience also includes representing Spansion against Samsung in an ITC action involving flash semiconductor memory, which was described as the largest ITC case ever brought.  Mr. Whitman represented Conner Peripherals in a multi-jurisdiction patent litigation against IBM involving over 20 patents directed to computer hard drives, which one Court referred to as "the largest patent litigation in history."

Mr. Whitman also advises clients on intellectual property licensing, portfolio management, portfolio mining, patent reissues, inter parte reviews (IPRs), the strategic acquisition and exploitation of intellectual property rights, and the rendering of opinions regarding the validity, scope and enforceability of patents.  Mr. Whitman spent several years as in-house litigation counsel at a Global 50 company, which has provided him with a unique ability to understand, and efficiently address, his clients' needs.

Mr. Whitman holds a bachelor of science degree in Electrical Engineering, is admitted to the bar in New York and New Jersey, and is admitted to practice before the U.S. District Courts for the Northern, Eastern and Southern Districts of New York, the Eastern District of Texas, the Northern District of California, the Court of Appeals for the Federal Circuit, the U.S. Supreme Court and the U.S. Patent and Trademark Office.

Work Experience

Mr. Whitman joined King & Wood Mallesons in January 2020. 

Prior to joining King & Wood, Mr. Whitman was managing partner of Mishcon de Reya NY LLP, and, prior to Mishcon, was a partner at King & Spalding LLP.
