Mr. Wizenfeld is a partner in the Intellectual Property Litigation Group of KWM’s New York office and has nearly twenty years of experience as a trial lawyer. He has participated in all aspects of patent litigation in district court and the International Trade Commission, including multiple trials and appeals. Mr. Wizenfeld also represents clients before the Patent Trial and Appeal Board of the United States Patent and Trademark Office.
Mr. Wizenfeld has also drafted petitions for certiorari before the Supreme Court, including one which resulted in the rare occurrence of the U.S. Solicitor General filing a supporting amicus brief recommending the Supreme Court grant certiorari (Interactive Wearables, LLC v. Polar Electro Oy, Case No. 21-1281).
Mr. Wizenfeld’s practice focuses primarily on the electrical and computer arts, and he has worked on matters involving diverse technologies including LEDs, EDA software for semiconductor design, computer networking devices, predistortion circuitry for use in optical transmitters, internet telephony, and automated systems for trading securities.
Mr. Wizenfeld also counsels clients with respect to evaluation of portfolio assets, including analysis of patent portfolios in various technologies in connection with licensing efforts, litigation, and strategic acquisitions. Mr. Wizenfeld’s practice further includes assisting clients with risk assessment, including analysis of infringement and validity risk and the corresponding drafting of freedom to operate opinions. Mr. Wizenfeld routinely advises clients on IP licensing matters, and has drafted and negotiated numerous licensing agreements, including patent licensing agreements, NDAs, and other commercial contracts.
Representative matters include:
- B.E. Technology, L.L.C. v. Google, LLC and Twitter, Inc. (D. Del.). Represented B.E. in district court litigations, and related PTAB proceedings, concerning targeted advertising technology.
- ChanBond, LLC v. Atlantic Broadband Group, LLC et al. (D. Del.). Represented plaintiff in patent infringement litigation against cable internet providers, resulting in a $125 million settlement reached during jury trial.
- In re Certain Light-Emitting Diodes and Products Containing the Same, ITC Investigations 337-TA-784 and 337-TA-802. Represented OSRAM in multiple ITC investigations concerning light emitting diodes.
- Pfizer Inc. et al. v. Teva Pharms. USA, Inc. (E.D.Va.). Represented Teva in litigation and Federal Circuit appeal involving patent covering use of Viagra®.
Work Experience
Before joining King & Wood Mallesons in 2020, Mr. Wizenfeld was a senior counsel at Mishcon de Reya New York LLP, as well as an associate in Goodwin Procter’s litigation department, where he represented both plaintiffs and defendants in complex patent disputes.
Mr. Wizenfeld earned his J.D. from Fordham University School of Law in 2004. Before law school, he earned his Bachelors degree in Physics with a minor in Mathematics from Yeshiva University in 2001.
Mr. Wizenfeld has been licensed to practice law in the State of New York since 2005. Mr. Wizenfeld is admitted to practice before the U.S. District Courts for the Southern and Eastern Districts of New York, the Eastern District of Texas, the U.S. Court of Appeals for the Federal Circuit, and the Supreme Court of the United States.
