Benjamin Bai focuses on high-stake intellectual property disputes involving complex patents, trade secrets, trademarks and copyrights, as well as unfair competition and antitrust claims.  He is particularly experienced in cross-border dispute resolution. Benjamin has approximately 30 years of extensive experience in intellectual property, coupled with a strong technical background and in-depth U.S. IP experience.

Benjamin has served clients from a wide range of industries, including pharmaceuticals, chemistry, semiconductors, communications, manufacturing, biochemistry, and Fintech.  He has provided strategic IP services to multinational companies and Chinese enterprises. He has led teams in handling groundbreaking litigation. With extensive experience in both law firms and corporations, Benjamin possesses exceptional business acumen, innovative thinking, and risk management capabilities. He has a proven track record in bet-the-company litigation and crisis management.

Benjamin has won many accolades.  In 2020, Managing Intellectual Property named him as one of the most influential IP people in the world.  From 2016 to 2021, he was selected by Intellectual Asset Management as one of the World's Top 300 IP Strategists. He was the winner of “China IP Lawyer of the Year” awarded by China Law & Practice in 2015.  Managing Intellectual Property listed Benjamin as an IP Star for the categories of Patent: Licensing, Protection & Litigation and Trade Secrets in 2014, 2015 and 2016

Work Experience

Benjamin joined King & Wood Mallesons in 2023.  Previously, he was an IP partner with Jones Day and Allen Overy in China and the U.S and subsequently held legal management positions with Ant Group and Amber Group. 

Benjamin received his B.S. in chemistry from the University of Science and Technology of China, Ph.D. in chemistry from Rice University, and J.D. from the University of Texas School Of Law. 

He is admitted to practice in the State of Texas and registered with the United States Patent and Trademark Office.
