Peter Bullock is a consultant in the Hong Kong office of King & Wood Mallesons. Peter acts for major information technology and telecommunications brands and for investors in and users of TMT systems and services. He advises on regulatory areas such as cyber risks, data law, FinTech and the digital economy, as well as employment and competition law matters. He also has extensive experience in conducting litigation, arbitration, mediation and investigations. He is also an HKIAC Accredited Mediator.

In relation to technology, Peter handles sourcing, licensing and IP exploitation and enforcement assignments. He has conducted various arbitrations, litigation, public inquiries and mediation in relation to some of the largest information systems and telecommunications projects in Hong Kong and overseas. His experience also includes advising on SFC investigations and competition law issues.

In relation to commercial TMT, Peter has advised users embarking on major IS change programmes on structuring and documenting their relationships with suppliers. He also regularly advises on risk management surrounding cloud services, cyber security and crisis response, relationships with regulators and TMT compliance in Greater China and beyond.

In relation to employment, Peter has advised on leading cases in the Hong Kong courts, including Cantor Fitzgerald v Boyer (and others) and Tullett Prebon v Nick Chan (and others). He advises on restrictive covenants and contractual interpretation, and is adept at balancing clients' desire to win individual cases with the wider precedent effect of decisions in key jurisdictions.

Peter has been recognised as a leading lawyer in Technology, Media and Telecommunications in Asia Pacific Legal 500 since 2002 and in Chambers since 1996. He is also recognised by Chambers and Asia Pacific Legal 500 for his work in the areas of Dispute Resolution, IP and Employment.

Chambers Asia 2015 highly recommends Peter and calls him a "market veteran, skilled at assisting companies in the information and technology sectors with risk management and dispute resolution." He is an "extremely focused and dedicated contentious practice" in the fields of IP and IT. Dispute resolution

  • Successfully acting for a Singapore listed CMM5 accredited software developer on a dispute with the Hong Kong Government in relation to the delivery of a major system for a government department; leading to and including a full arbitration.
  • Acting for a world leading telecoms network supplier in relation to a contractual dispute with the operator of a Hong Kong mobile network concerning the provision and extension of a 3G network across Hong Kong.
  • Acting for the key systems supplier of the Flight Information Display System in relation to the public inquiries into the opening of the new Hong Kong International Airport.
  • Acting for the Italian purchasers of rolled stainless steel, in an HKIAC arbitration against the Austrian vendors, successfully making claims arising from damage to the metal during transportation from China to Italy.
  • Acting for the (successful) Plaintiff in the Internet defamation case of e-silkroad.net Limited v Icered.com Limited.

Technology, media and telecommunications (TMT)

  • Advising the Asian business of a French owned international insurance group on a regional print flow standardisation programme, across 8 countries, let to a major international service provider on a systems integration basis.
  • Advising a Japanese owned systems-to-services vendor on a series of data centre outsources to customers in the banking and telecommunications sectors in Hong Kong.
  • Advising the Hong Kong gas utility company on the negotiation and documentation of a major SAP implementation with Accenture.
  • Acting for a Hong Kong headquartered internationally renowned hotel company in relation to various system procurement contracts for in-room entertainment systems and cloud services, over many years.
  • Advising the prime contractor on supply, intellectual property and project risk issues connected with the delivery of the Hong Kong Immigration Department's implementation of an Automated Passport and Vehicle Clearance System adopting smart card technology, a HK$800 million contract.

Intellectual property

  • Acting for liksang.com defending proceedings by Sony (issued in Hong Kong and latterly the UK) concerning alleged parallel importation of PlayStation Products arising out of an Internet site operated from Hong Kong.
  • Acting for Tencent Holdings Limited in relation to licensing of their QQ platform in India and associated option agreement.
  • Advising a UK Premier League Football Club on a sponsorship agreement with a leading PRC soft drinks manufacturer.
  • Advising an insurance broking to professional services MNC on a standardisation project for data protection forms across 14 jurisdictions in Asia Pacific.
  • Adjudicating over 25 domain name arbitrations, as arbitrator.

Employment

  • Advising the Plaintiffs in Cantor Fitzgerald v Boyer (and others), securing an interlocutory injunction and taking the case to trial (and associated Labour Tribunal proceedings). The case is a leading authority on enforceability of post termination restrictive covenants in Hong Kong.
  • Advising the Defendants in Hong Kong Court of First Instance proceedings Tullett Prebon v Nick Chan (and others), which concerned the freedom of a desk of brokers to move without restriction from one to another rival brokerage.
  • Acting for a Hong Kong headquartered international architectural practice in claims against a former director arising out of competitive business practices allegedly in breach of post termination restrictive covenants.
  • Acting for a Hong Kong listed computer hardware manufacturer in defending claims by a female manager against a more senior manager concerning sexual harassment and discrimination.
  • Successfully defending a former employee moving to a software developer for the pay TV industry sued by his former employer for alleged breach of confidence and breach of restrictive covenants.
