Michael DeVincenzo has over twenty-five years of experience as a trial and appellate lawyer.
Mr. DeVincenzo is a first-chair trial litigator with extensive experience in federal trial and appellate courts across the country and before the International Trade Commission (ITC). His practice has particularly focused on high-tech litigations involving intellectual property disputes. Mr. DeVincenzo has led patent teams in numerous high-profile patent litigations and appeals including for clients JP Morgan, International Securities Exchange, Teva Pharmaceuticals, and ChanBond Communications. Mr. DeVincenzo’s practice involves a wide range of technologies including practices including business methods, financial service industry products, computer hardware and software, circuitry, electronic components, business methods, medical devices, video, audio and telecommunication devices. Mr. DeVincenzo has been appellate counsel in some leading Federal Circuit Cases, including TLI Communications LLC v. AV Automotive, L.L.C., McRO Inc. v. Bandai Namco Games America Inc. and Interactive Wearables, LLC v. Polar Electro Oy, a rare instance of the U.S. Solicitor General filing a supporting amicus brief recommending the Supreme Court grant certiorari (Interactive Wearables, LLC v. Polar Electro Oy, Case No. 21-1281), as well as before the D.C. Court of Appeals.
Mr. DeVincenzo has further focused his career on counseling clients with respect to portfolio management, portfolio mining, patent reissues, patent reexaminations, the strategic acquisition and exploitation of intellectual property rights, and the rendering of opinions regarding the validity, scope and enforceability of patents.
In addition to his advisory experience, Mr. DeVincenzo has experience in-house as a former General Counsel and Chief Intellectual Property Counsel for a advanced semiconductor material company. This prior experience has allowed him to understand and efficiently address the concerns of clients that may arise during the course a representation.
Some recent case related successes include:
- Led a trial team in a multi-defendant patent case that resulted in a nine-figure settlement reached following the closing of Plaintiff’s case in chief.
- Secured summary judgment on behalf of Bell Helicopter Textron Inc. in a case against Eurocopter involving patents related to helicopter components.
- Represented OSRAM in multiple ITC investigations concerning the importation of light emitting diodes.
- Obtained an injunction on behalf of CardinalCommerce Corp. against its competitor, SecureBuy LLC, with respect to intellectual property regarding software.
Work Experience
Before joining King & Wood Mallesons in 2020, Mr. DeVincenzo was a partner in Goodwin Procter’s Intellectual Property group and at Mishcon de Reya New York LLP, where he represented both plaintiffs and defendants in complex intellectual property related disputes.
Mr. DeVincenzo earned his J.D. from Fordham University School of Law in 2000. Before law school, he earned a Bachelor of Engineering degree from Stevens Institute of Technology..
Mr. DeVincenzo is licensed to practice in New York state and in the U.S. District Courts for the Southern and Eastern Districts of New York, the Eastern District of Texas and the U.S. Court of Appeals for the Federal Circuit, the D.C. Court of Appeals and the Supreme Court of the United States.
