His practice focusses on providing legal advice to clients on various aspects of environmental and planning law, including planning approval pathways for major projects, biodiversity, Aboriginal cultural heritage and native title, compulsory acquisition and valuation of land, pollution and contaminated land, environmental due diligence, waste and water. Guy advises and acts for clients in both transactional and litigation settings, particularly in relation to the resources (mining and gas), renewable energy and commercial development sectors. He frequently provides representation to clients in relation to environmental compliance and enforcement actions involving pollution incidents.
In addition to these traditional aspects of environmental law, Guy also advises and acts for clients on matters relating to climate change law, especially as it relates to carbon capture and storage and carbon markets. His experience in this regard includes:
- acting for well-known Australian and international resource companies on the development of carbon capture and storage projects (both domestically and internationally, particularly in relation to projects involving application of international environmental law);
- drafting and negotiating emission reduction purchase agreements involving trading of carbon credits generated through participation in accredited carbon markets (both for project proponents generating credits and multinational corporations purchasing such credits to meet their own carbon commitments);
- acting for a leading voluntary carbon accounting standard; and
- advising clients on greenhouse gas emission reporting and participation in eligible offsets projects as part of the implementation of the Emissions Reduction Fund in Australia.
Guy also maintains an active involvement in legal academia and professional development in these areas of law. He is an updating author for the loose-leaf services Environmental Responsibilities Law NSW and Planning Law in Australia (produced by Thomson Reuters) and has had works published in edited books and academic journals on environmental, planning and climate change law.
