Stephanie Hung is a Counsel in the Hong Kong office of King & Wood Mallesons.

Stephanie’s practice covers a wide spectrum of contentious commercial litigation, arbitration and advisory works, involving areas of cross-border insolvency, restructuring and receivership matters, companies winding-up and bankruptcy actions, assets tracing and recovery, shareholders and directors disputes, general contractual disputes, regulatory investigations and competition law enforcement actions.

She is fluent in Cantonese, English and Mandarin.

RELEVANT EXPERIENCE

Dispute Resolution

  • Acted for an offshore company in an application for Emergency Arbitrator in relation to misappropriation of US$40million worth bitcoins and subsequent arbitral proceedings
  • Acted for an offshore company in disputes relating to US$7million worth Convertible Bonds
  • Acted for a leading semiconductor company based in the Netherlands in a series of disputes against its distributors for breach of distribution agreements
  • Advised a major property owner and developer in Hong Kong on general legal advice including rental enforcement actions and possession applications
  • Acted for a Hong Kong stock brokerage firm and investment bank in debt recovery proceedings
  • Represented two principal subsidiaries of a Chinese publicly traded rolling stock manufacturer against a Singapore listed company in a HKIAC arbitration in relation to enforcement of securities over US$60 million worth
  • Acted for an Australian liquidator in a High Court action in relation to judicial recognition of a foreign winding-up order
  • Acted for nine leading banks in Hong Kong against a BVI company and its HK listed subsidiary, include providing legal advices on matters relating to cross-border insolvency, winding up proceedings in the BVI court, appointment of liquidators, application to HK court for recognition of a BVI winding up order and a disclosure order

Antitrust

  • Representing the Hong Kong Competition Commission in an enforcement action against a property agency giant before the Competition Tribunal and related Judicial Review proceedings
  • Represented the Hong Kong Competition Commission in three enforcement actions before the Competition Tribunal and subsequent appeals before the Court of Appeal
  • Acted as the Independent Compliance Advisor of Gray Line Tours Limited pursuant to its Cooperation Agreement with the Hong Kong Competition Commission

Insolvency and Restructuring

  • Acted for a Hong Kong textile manufacturer in conducting creditors’ voluntary winding-up of its Hong Kong subsidiaries
  • Acted for a Hong Kong listed real-estate developer in Mainland China on issues relating to insolvency and restructuring of the company
  • Advised leading banks on purchase of non-performing loans
  • Represented a Hong Kong company in defending winding-up petition and obtaining court sanction in restructuring proceedings
  • Advised a Hong Kong and PRC listed company on insolvency, enforcement of securities and receivership
  • Advised a global consulting firm on receivership and enforcement issues
  • Represented Hong Kong and PRC financial institutions in bankruptcy proceedings
