The King & Wood Mallesons (KWM) dispute resolution team in London has obtained another success in the Commercial Courts in favour of long standing client and global FX broker FXCM.
The robust judgment upheld a key provision of FXCM's terms of business that allowed it to protect itself from abusive trading and to ensure that its platforms are not misused to the detriment of its genuine retail clients.
This was the second judgment from His Honour Judge Waksman QC obtained by the KWM team in almost as many months, having won the case of Watson & Ors v Watchfinder in May this year, which dealt with the correct scope of the "Braganza Duty" when exercising a contractual discretion.
The KWM team for FXCM were partner Dorothy Murray, associate Llewellyn Spink and paralegal Valentine Kerboull.
