Scott specialises in the management of major projects and infrastructure disputes. He acts for contractors, consultants & principals in claims for variations, extensions of time, acceleration, defects, latent conditions & access related disputes. He represents clients in the building, construction, resources & energy and real estate sectors in State & Federal Courts, domestic and international arbitral proceedings & adjudication disputes.

Scott complements his construction disputes practice with a strong knowledge of the insurance products used in the construction & resources industries. Although based in the Brisbane office of KWM, Scott is mobile and regularly acts for clients in disputes across Australian states and in Asia.

Scott's work highlights include advising:

  • global contractor as defendant and counter-claimant in a SIAC international arbitration concerning the construction of iron ore processing facilities on the Roy Hill project in Western Australia.
  •  tier-one Australian contractor in arbitral proceedings conducted in the UAE and Queensland concerning conveyor and ship-loading works at the Abbot Point Coal terminal in Queensland.
  • tier one contractor in defence claims brought by a subcontractor for work on the QCLNG project to be heard in the Queensland Supreme Court.
  • tier one contractor as claimant in a Singaporean-seated international arbitration concerning work performed on the Ichthys gas project in the Northern Territory.
  • gas pipeline owner as defendant in claims brought by a pipeline laying contractor on pipeline expansion works to be heard in the NSW Supreme Court.
  • global energy company as defendant in disputes filed in the NSW Supreme Court concerning a co-cycle power plant in Western Australia. In addition to the above recent matters, Scott's previous experience extends to disputes and advice work on roads, tunnels, rail, airport infrastructure and runways, hospitals, mineral processing (coal, iron ore, hard rock), dams, pipelines (gas and water), water processing (desalination and recycling), power plants, high rise residential buildings, convention centres, civil works (including retaining walls), control systems and pavement disputes.

Scott also has specific experience with the builder's licensing regime in Queensland and has acted for builders to address regulatory notices and licensing issues (including directions to rectify and license suspensions).
