Areas of practice

Liu Xinyu is a member of the Management Committee of King & Wood Mallesons (KWM) and the lead partner of customs and foreign exchange practice. He specialises in international trade and dispute resolution, export control, customs (including commodity inspection) compliance, foreign exchange and other compliance matters and corporate M&A.

With more than 30 years of experience, Mr. Liu has advised on hundreds of matters in these areas involving dutiable value, HS classification, country of origin, processing trade, duty exemption, solid waste, and inspection and quarantine. He assists clients in responding to the proposed administrative penalties, seeking administrative reconsiderations, initiating administrative litigation, and defending against smuggling crime and other similar allegations. He regularly advises on foreign exchange control related matters in respect to cross-border capital flows. Mr. Liu counsels many high-tech enterprises on export control and economic sanctions involving China or other countries. He assists enterprises in developing emergency response plans and solutions as well as establishing and improving compliance programmes.

In addition to handling a large number of high profile matters, Mr. Liu is also active in participating in legislative research and consultation and providing his expertise on civil and administrative cases.

In particular, Mr. Liu has handled hundreds of foreign investment, M&A and restructuring matters. He also represents domestic and overseas clients in arbitration proceedings before the China International Economic and Trade Arbitration Commission (CIETAC), the ICC International Court of Arbitration and other arbitration institutions. He has actively promoted the use of alternative dispute resolution procedures, such as mediation.

In 2021 and 2022, Mr. Liu was named as a Notable Practitioner in "International Trade: Customs, Export Control & Economic Sanctions” by Chambers and Partners. He is also highly recommended in the field of “WTO/International Trade” in the Asia-Pacific region by The Legal 500.

Work experience 

Before joining KWM in 2005, Mr. Liu worked for a private law firm in Beijing. After Mr. Liu completed his studies in Japan, he served as the PRC counsel for years at the headquarters of a Fortune 500 corporation in Japan.

Mr. Liu received his LL.B. in International Economic Law from Fudan University in 1990. He received his LL.M. in Civil Law and International Economic Law in Japan and completed a doctoral programme in International Economic Law while working there.

Mr. Liu is an adjunct professor at the graduate school of China University of Political Science and Law, Co-director of the Institute of Customs and Foreign Exchange of Renmin University of China, Co-director of the Cross-border Sanctions and Export Controls Research Centre of Beijing Foreign Studies University, and a committee member of the 10th All-China Youth Federation.

Mr. Liu is on the panel of arbitrators of the CIETAC, the Japan Commercial Arbitration Association (JCAA), and the Harbin/Wuhan/Dalian Arbitration Commissions.

He is proficient in Chinese, Japanese, and English.
