Building a top-tier bay area and world-class urban agglomeration with vitality and international competitiveness constitutes the long-term strategic objective of the Guangdong-Hong Kong-Macao Greater Bay Area (GBA) construction. 2022 is a key year for the in-depth promotion of the construction of Guangdong-Macao In-Depth Cooperation Zone in Hengqin and Qianhai Shenzhen-Hong Kong Modern Service Industry Cooperation Zone as the economic strength and regional competitiveness of the GBA have been significantly enhanced. In this context, the GBA will further build a new open economic system, create a high-level open platform, follow high-standard trade and investment rules, accelerate the cultivation of new advantages in international cooperation and competition, give full play to the unique advantages of Hong Kong SAR and Macao SAR, innovate and improve the opening and cooperation mechanisms in multiple fields, and deepen mutually beneficial cooperation between the mainland and Hong Kong SAR and Macao SAR.

Legal construction is a vital issue in the GBA construction. King & Wood Mallesons (KWM), in response to the national development strategy, is committed to providing customers with multi-field and comprehensive legal services in the GBA. Since 2018, the KWM International Center in the GBA has continuously released the “Law and Practice in the Greater Bay Area” series (No. IV), and the fourth issue of the Chinese version of the series was released in July 2022. This publication is the English version of the fourth issue, which has integrated KWM’s professional observations and reflections on the laws and practices in the GBA, involving financial and capital markets, investment and financing, dispute resolution, corporate listing, corporate compliance and other fields, to assist customers accurately comprehend the laws and regulations and the latest policies of the GBA, and timely grasp market opportunities.

Whether training AI models with copyrighted materials constitutes copyright infringement is a heavily debated and litigated topic in China and around the world. In this article, we examine the matter with a step-by-step breakdown of the technical process for training AI models and reveal that copyrighted works may be stored only briefly in the memory of computing devices. Additionally, we discuss how AI model training temporarily uses stored copyrighted works for “understanding” and “extracting” concepts and ideas, rather than retaining particular expressions for “independent economic value,” and what this means under copyright laws.
