Dan Miller’s practice focuses on patent litigation and client counseling. He has almost 20 years’ experience litigating patents in district courts throughout the United States and before the International Trade Commission.

Mr. Miller has worked on high-profile patent litigation matters involving large companies spanning a wide range of industries, including consumer electronics, telecommunications (including mobile telephony, wireless infrastructure, and wireless standards), semiconductors (including processor design and implementation and memory systems), and computer software (including operating systems, storage systems, graphical user interfaces, and XaaS).

Mr. Miller has split his career between law firm practice and as in-house counsel. He spent eight years in-house, including almost seven years as litigation counsel at a global Fortune top 10 company. While in-house, he had the opportunity to oversee and manage high-profile, high-stakes litigation. This experience allows him to better advise clients concerning their goals and objectives.

Mr. Miller also advises clients on intellectual property licensing, patent portfolio strategy, patent portfolio mining and analysis, post-grant patent office proceedings (including inter partes reviews and ex parte reexaminations), competitive patent analysis, and patent acquisition.

Work Experience

Mr. Miller joined King & Wood Mallesons in March 2022.

Prior to joining King & Wood Mallesons, Mr. Miller was a partner at Hall Booth Smith, P.C.. Before that, Mr. Miller practiced law at several major law firms, including Kasowitz Benson Torres, King & Spalding, and Kenyon & Kenyon.

Mr. Miller was in-house litigation counsel at Google and MicroStrategy.

Mr. Miller received a J.D. from the University of Texas at Austin School of Law, an M.S. in Computer Science from Shippensburg University of Pennsylvania, and a B.A. in Mathematics from Grace College.

He is admitted to the bar in New York and the District of Columbia, and is admitted to practice before the United States District Courts for the Eastern District of New York, Southern District of New York, Eastern District of Wisconsin, and Western District of Texas, and before the United States Court of Appeals for the Federal Circuit.
