Our annual flagship publication The Review: Class Actions in Australia 2022/2023 considers judgments, events and developments between 1 July 2022 and 30 June 2023.

In this period 53 new class actions were filed across Australia, marking the lowest total since 2016/2017.

The review period has seen:

  • Consumer and securities claims headlining new filings
  • An influx in data breach related filings, specifically across privacy breaches consumer claims and a securities claim alleging breach of continuous disclosure obligations following a cyber-attack
  • Group costs orders driving filings in the Victorian Supreme Court
  • More than $1B in settlements approved for the first time since 2019/2020
  • The Federal Court scrutinising the proposed distribution of settlements, to plaintiff lawyers and funders.
