With the situation in regard to COVID-19 changing almost daily, it is challenging to keep up with the latest developments from Federal and State Governments. This table provides an overall summary, followed by a state by state timeline, of the material restrictions on businesses, venues and movement that have been imposed, as well as other relevant legislative changes that have been made, by the Australian, State and Territory Governments in response to the COVID-19 outbreak, as at 20 August 2020. The Federal Court has refused an application to stay proceedings to quantify compensation for patent infringement (quantum proceedings) pending the outcome of separate parallel proceedings challenging the validity of the infringed patent on new grounds. The case is significant as intellectual property cases are regularly bifurcated with liability determined separately damages or an account of profits. A patentee may also bring consecutive infringement cases and therefore have two separate cases considering invalidity issues for the same patent running in parallel.
