Schedule 1 - Australia

Fees

The following fees apply to recruitment for roles in Australia. In all cases, the fees stipulated below are in Australian dollars and are exclusive of GST.

For the purposes of clause 5.2(b) of the terms and conditions, the relevant time period is the later of:

  • 30 days from the commencement of the successful candidate at KWM; and

  • 30 days from the receipt of the tax invoice (and, if applicable, the supporting information or documentation), which cannot be issued prior to the successful candidate’s commencement at KWM.

All references to the annual salary packages below are inclusive of the employer superannuation guarantee (currently 11.5%), but are exclusive of any sign-on bonus, any other bonus or allowance and any profit share or any other identifiable financial benefit.

 

A. Shared services and support staff – permanent role

Shared services means all non-legal roles, including human resources, administration, finance, marketing, technology, hospitality, research/knowledge management and facilities management. Support includes practice assistants and word processors.

The fee is the greater of:

  • $2,000; or

  • the relevant percentage of successful candidate’s salary package in Table 1.

B. Legal staff – permanent role

Legal staff does not include graduate roles, unless KWM expressly agrees otherwise. 

The fee is the greater of:

  • $2,000; or

  • the relevant percentage of the successful candidate’s salary package in Table 2.

C. Fixed term contract role – shared services or legal

Full-time fixed term contract roles for a minimum period of 3 months and a maximum period of 12 months.

The fee payable is the greater of:

  • $2,000; or

  • the relevant pro rata proportion of the fee that would be payable under A or B if the role was permanent.

 

D. Part-time roles – permanent and fixed term contract

The fee payable is the greater of:

  • $2,000; or

  • the applicable part-time discount in Table 3 off the fee for a:

  • permanent role under A or B

  • fixed term contract role under C,

as applicable.

E. Fixed term contract role converting to permanent role

If a fee has been paid already under C, a further fee will be payable equal to the greater of:

  • $2,000 or

  • the fee payable for the permanent role under A or B minus the fee already paid under C.

 

F. Casual employees converting to permanent or contract role

The fee is dependent on how long the candidate was employed by KWM on casual basis and will be a percentage of the fee, as set out in Table 5, of what would be payable under A B or C, as relevant to the role.

However, if at the time the employee commences work on a permanent or fixed term contract role basis the agency has already been paid fees in respect of that employee which are the equivalent of a permanent or fixed term contract role placement fee respectively, no further fee (including any permanent placement fee) is payable to agency in respect of that employee.
