Mr. Yin Juquan specializes in labor law, employment law and social security law.

Mr. Yin Juquan acts as legal counsel of a number of renowned corporations and provides legal service for a number of companies, including multi-national corporations, leading Chinese state-owned enterprises, listed companies, financial companies, and other foreign invested entities in China. The scope of service involves all aspects of employment and social security law, including drafting, reviewing and revising employment contracts and related agreements, drafting, revising and implementing internal labor rules and policies, providing legal consultation service on labor relationship and employee training, providing employee settlement plan for enterprises in the context of merger & acquisition, bankruptcy, restructuring, dissolution, liquidation and participating in the negotiation on behalf of enterprises, handling issues related to labor unions and collective negotiation and providing legal opinions on issues regarding social insurance and housing funds. Mr. Yin also participates in the negotiation with the senior management employees (including foreign employees) on the conclusion and termination of labor contracts on behalf of enterprises.

In addition, within his 14 years’ experience of practicing labor and employment law, Mr. Yin has represented clients before various arbitration committees and courts in mainland of China for more than two thousand labor dispute cases, and is sufficiently experienced in labor disputes resolution. He has dealt with all kinds of labor disputes arbitration and litigation, which involves all aspects of labor law, employment law and social security law, including the legality of the termination of labor contracts, the performance of non-competition obligations, the payment of OT wages, the compensation for work-related-injuries and the payment of social insurance premiums, etc.

Mr. Yin has extensive experience in dealing with employee strikes and crisis management. The similar matters handled by him each year are more than 8, including the most lasting and devastating strike in Shenzhen so far. The crisis managed by him include but are not limited to crisis between the Supplier and one Wholly Foreign-Owned Enterprise, strike caused by order of suspending business for internal rectification issued by government, strike caused by change of shareholder, strike caused by divestment and adjustment of business operation mode, etc.

Mr. Yin Juquan is ranked as one of the leading individuals in employment area by Chambers & Partners from 2012 to 2015.In 2014, Mr. Yin won the award of Individual award (rising star) for Labor & Employment, presented by China Law & Practice. In 2015, Mr. Yin has been named as one of the highly recommended lawyers in the field of employment in China by Legal 500 in its 2016 Asia Pacific rankings. Mr. Yin has been ranked as a “Leading Individual” by Chambers Asia Pacific Guide consecutively for five years from 2012 to 2016 in labor law.

Mr. Yin Juquan obtained his LL.B. from China University of Political Science and Law, and was admitted as a Chinese Lawyer in 1997.
